Practice Description

Li Jingbing specializes in litigation and has extensive experience in dealing with a variety of complex litigation matters, particularly in the areas of intellectual property, business litigation and trade disputes.

Mr. Li Jingbing is a highly ranked trial and appellate lawyer. He has represented both plaintiffs and defendants in commercial litigation matters since 1990 throughout China. He has successfully handled various types of business disputes, including business torts, product liability, breach of contract, breach of fiduciary duty, insurance, international trade law, trade defamation, unfair competition and antitrust. Court opinions in several matters he has handled have been selected as exemplary decisions by local courts and the Supreme People’s Court.

In the intellectual property area, Mr. Li Jingbing has extensive experience in all aspects of trademark, trade dress and trade secret, software copyright and patent litigation, representing both plaintiffs and defendants at trial and appellate court proceedings. He has successfully advised IP right owners in enforcing their protection strategies. He has also prosecuted important administrative actions before the State Trademark Office and the State Intellectual Property Office. He has proved his litigating abilities and professional skills nationwide, particularly in Higher People’s Courts and the Supreme People’s Court.

As one of China’s first-generation IP lawyers, Mr. Li Jingbing is most experienced with litigation in the IP judicial courts at all levels. Among the numerous complicated and original litigation cases in the field of trademark, patent and copyright that he has handled, many have been used and cited as examples on the proper handling of an Intellectual Property case.

Mr. Li Jingbing has intimate knowledge of administrative proceedings for relevant state administrations, including, but not limited to, the Trademark Office; the Trademark Review Adjudication Board; the State Intellectual Property Office; the Patent Reexamination Board; the State Copyright Bureau; the Administration of Quality Supervision, Inspection and Quarantine; the State Food and Drug Administration; and the IP Protection Department of the General Administrations of Customs.

Mr. Li Jingbing has significant international trade law experience, representing clients in arbitration, antidumping investigation and WTO dispute settlement procedure, where he was one of the first Chinese lawyers to represent Chinese industry in Geneva since China’s accession.
